2. Your Responsibilities as a User

By using Wish-A-Day, you agree to:

• Use the Service responsibly and in a manner consistent with its purpose of spreading positivity.
• Respect the rights and dignity of others in the community.
• Refrain from posting content that is unlawful, harmful, abusive, offensive, defamatory, or otherwise objectionable. This includes not sharing sensitive personal information about yourself or others.
• Comply with all applicable local, state, national, and international laws and regulations.
• Not misuse our Service (e.g., by interfering with it or trying to access it using a method other than the interface and instructions we provide).

3. Content on Wish-A-Day

• You retain ownership of the intellectual property rights in the wishes and other content you submit to the Service ("Your Content").
• By submitting Your Content, you grant Wish-A-Day a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform Your Content in connection with the Service and Wish-A-Day's (and its successors' and affiliates') business, including for promoting and redistributing part or all of the Service.
• We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms or our policies.
• Our automated systems analyze Your Content (including wishes) to provide you personally relevant product features, such as customized search results, and for spam and malware detection, and toxicity flagging. This analysis occurs as the content is sent, received, and when it is stored.

4. Intellectual Property of Wish-A-Day

The Wish-A-Day platform, including its "look and feel" (e.g., text, graphics, images, logos), proprietary content, information and other materials, are protected under copyright, trademark and other intellectual property laws. You agree not to copy, modify, or redistribute any part of the Service or its content, other than Your Content, without our express written permission.

5. Disclaimers and Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Wish-A-Day disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Wish-A-Day shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

Our liability for any claims related to the Service is limited to the greater of $50 USD or the amount, if any, you paid us to use the specific Service feature giving rise to the claim during the 12 months before the claim arose.

6. Data Privacy and Security

Your privacy is important to us. Our Privacy Policy and Data Protection Notice explain how we collect, use, and protect your personal information. By using our Services, you agree to the collection and use of information in accordance with these policies.

7. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by using the "Delete My Data" feature in your profile, which will also remove your associated data as described in our Privacy Policy.
